TopEssay.com is owned and operated by COMPANY OÜ (Reg. Nr. 11111111, Address 1111) (“TopEssay”, “we”, “us”, “our”).
By accessing the Website or using our marketplace and related services (the “Services”) you agree to these Terms & Conditions (“Terms”). If you disagree with any part, please stop using the Services immediately.

1 Scope of Services

• TopEssay links individuals or organisations that need written content (“Clients”) with independent freelance writers (“Experts”).
• The content delivered (“Work”) is for reference, research and learning only. Clients must not submit it as original work where academic or professional rules forbid it.
• Services are available only to users aged 16 years or older and not resident in jurisdictions sanctioned by the EU, OFAC, FATF or where such marketplaces are illegal. We may block or terminate accounts from restricted areas.

2 Account Registration

• Create an account with a valid e-mail and strong password; keep credentials confidential.
• You are responsible for all activity under your account. Report any unauthorised access to team@top-essay.com immediately.

3 Ordering Process

1. Post Order – specify topic, word-count, deadline, formatting, and upload reference files.
2. Select Expert – review bids and choose the Expert you prefer.
3. Secure Messaging – communicate only through the on-site messenger.
4. Track Status – shows the status of your project.
5. Client duties – provide complete instructions and all reference material while forming an order.

Failure may cause delays, extra fees or scope changes.

4 Payment & Pricing

• All prices are shown in real time during checkout (EUR). We may update prices but never retroactively on active orders.
• Advance payment only (Visa, Mastercard, AmEx, Maestro, JCB, Diners Club).
• Automatic Payment Release – funds are held in escrow and released to the Expert 14 days after the final deadline unless the Client opens a dispute or revision request.

5 Revisions & Refunds

Revisions

• One free revision if the Work diverges from original instructions.
• Extra or out-of-scope changes may incur additional charges.

Refunds

Refunds may be issued when:

• Non-delivery of services
• Significant deviation from order requirements
• Technical issues preventing completion
• Request submitted within 14 days of the transaction

Refunds will not be granted for:

• Dissatisfaction with grades or academic performance
• Failure to supply required references on time
• Misuse of the Work for academic dishonesty
• Requests made after six months from the transaction date

Refund processing takes 3-6 business days, depending on the payment provider.

6 Intellectual Property & Usage Restrictions

• TopEssay retains ownership until full payment clears.
• After release, the Client receives a non-exclusive licence for lawful personal or organisational use.
• Prohibited: resale, public distribution, or claiming authorship of the Work.

7 Plagiarism & Academic Integrity

• Zero-tolerance for plagiarism. You agree not to present our Work as original academic submission, infringe copyright, or violate institutional rules. Breaches may lead to instant termination.

8 Data Privacy & Security

• We collect only data necessary to operate the marketplace. See our Privacy Policy for details on collection, safeguards and your rights.
• Personal data are never sold and are disclosed to third parties only where legally required or essential to provide the Services.

9 Account Suspension & Termination

We may suspend or close your account without notice if you:

• Commit fraud, payment charge-backs, or policy violations
• Harass Experts or staff
• Attempt to bypass platform security or controls

10 Limitation of Liability

• Services are provided “as is” without warranties.
• TopEssay is not liable for indirect, special or consequential damages, or delays caused by external factors (e.g., internet outages).
• We do not guarantee grades or institutional approval of your use of the Work.

11 Governing Law & Dispute Resolution

These Terms are governed by COMPANY ADDRESS COUNTRY law. Disputes will be resolved by arbitration in COMPANY ADDRESS COUNTRY; class or collective actions are excluded.

12 Amendments & Updates

We may amend these Terms at any time. Continued use after changes take effect constitutes acceptance.
